Eligibility Policy

1.Minimum Age

You must be at least 13 years old to create an account on The Tide.

If you are under the age of majority where you live, your parent or legal guardian may be required to consent to your use of the Service.

The Tide is not intended for children under 13, and children under 13 may not create accounts.

If we learn that an account belongs to a child under 13, we may suspend or delete the account and take appropriate steps regarding information associated with it.

If you believe a child under 13 is using The Tide, please contact privacy@thetide.xyz.

2.Legal Capacity

You must be legally permitted to use The Tide.

By creating an account, you represent that:

• you have the legal capacity to agree to our Terms of Service; or
• if applicable, your parent or legal guardian has provided any consent required by law

You may not use The Tide if applicable law prohibits you from receiving or using the Service.

3.Account Information

When The Tide requests information necessary to create or maintain an account, you agree not to intentionally provide false or materially misleading information.

Depending on the features available, this information may include:

• email address
• username
• display name
• country
• age or date-of-birth information
• profile information
• other information reasonably necessary to operate the Service

You are responsible for keeping information associated with your account reasonably current.

4.One Person, One Authentic Presence

The Tide is intended to foster authentic human participation.

You may not create an account for the purpose of:

• impersonating another person
• pretending to be another real person
• misleading people about who operates an account
• evading an account suspension or termination
• conducting fraud
• manipulating engagement
• deceiving members of the Tide community

Pseudonyms, nicknames, community names, or other non-legal display names may be permitted unless a particular feature expressly requires verified or legal identity information.

Using a display name that differs from your legal name does not by itself constitute impersonation.

5.Organizations and Community Accounts

The Tide may permit businesses, nonprofit organizations, charities, schools, community groups, clubs, churches, volunteer organizations, or other entities to maintain accounts.

If you create or operate an account on behalf of an organization, you represent that you are authorized to do so.

You may not falsely claim to represent an organization, charity, business, government agency, public figure, or community group.

The Tide may establish additional requirements for organizational accounts.

6.Previously Suspended or Terminated Users

If The Tide previously permanently terminated your account for a serious violation of our Terms of Service or Community Guidelines, you may not create another account to evade that termination unless we give you permission to return.

Creating additional accounts to avoid enforcement may result in those accounts being removed.

Not every prior suspension or account deletion necessarily makes someone permanently ineligible. Eligibility may depend on the reason for and circumstances surrounding the previous enforcement action.

7.Geographic Eligibility

The Tide may be available in multiple countries and jurisdictions.

Availability in a particular country does not necessarily mean every Tide feature is available there.

Certain features may be restricted or unavailable because of:

• local laws
• regulatory requirements
• age requirements
• privacy requirements
• sanctions
• technical limitations
• payment restrictions
• other legal or operational considerations

You are responsible for complying with laws applicable to your use of the Service.

8.Sanctions and Restricted Parties

You may not use The Tide if doing so would cause The Tide to violate applicable economic sanctions, export-control laws, trade restrictions, or other applicable legal requirements.

Where required by law, we may restrict access to the Service based on geographic location or a person’s status under applicable sanctions programs.

9.Eligibility to Post Content

Being eligible to have a Tide account does not automatically mean you have the right to post every photograph, story, or piece of information in your possession.

When posting content, you remain responsible for complying with our:

• Terms of Service
• Community Guidelines
• Privacy Policy
• applicable law

In particular, you should have the rights, permissions, or other lawful basis reasonably necessary to upload photographs or information involving other people.

10.Photographs Involving Children

Adults and eligible users may sometimes post photographs involving children — for example, photographs of family activities, community events, volunteering, or acts of kindness.

The fact that a child appears in a photograph does not mean the child has a Tide account or is eligible to operate one.

Users posting photographs involving children are responsible for ensuring they have any permission or authority required to share those photographs.

The Tide may remove or restrict content involving children when we reasonably believe the content:

• compromises a child's safety
• exposes highly sensitive information
• violates a child's privacy
• exploits or humiliates a child
• sexualizes a child
• depicts abuse or exploitation
• violates our Community Guidelines
• violates applicable law

Parents and legal guardians may contact us about content involving their children at privacy@thetide.xyz.

11.No Eligibility Based on Popularity

The Tide is about kindness — not popularity.

You do not need:

• a minimum number of followers
• a certain level of social influence
• a public profile
• celebrity status
• a certain number of posts
• a particular profession
• a certain income
• membership in an organization
• a history of charitable activity

to participate in The Tide.

Subject to this Eligibility Policy and our other policies, The Tide is intended for ordinary people who want to participate in a community centered around kindness.

12.No Requirement to Give Money

You do not need to donate money, purchase anything, make financial contributions, or provide material assistance to be eligible for The Tide.

Acts of kindness can take many forms.

The Tide does not define kindness solely by monetary value.

Sharing encouragement, volunteering time, helping another person, supporting a community, expressing gratitude, or performing other positive actions may all be part of the Tide community.

13.Participation Must Be Voluntary

You may not force, threaten, deceive, or improperly pressure another person to participate in The Tide or appear in content for the purpose of satisfying an eligibility requirement, receiving recognition, or generating engagement.

Participation in acts of kindness should be voluntary.

People receiving assistance should be treated with dignity and respect.

14.Automated Accounts and Bots

Unless expressly authorized by The Tide, automated systems, bots, scripts, or other non-human accounts are not eligible to participate as ordinary Tide members.

You may not use automation to:

• create large numbers of accounts
• artificially generate engagement
• manipulate reactions or interactions
• post spam
• harvest user information
• misrepresent human participation
• circumvent Service limitations

The Tide may authorize certain automated accounts or integrations for legitimate operational, community, safety, or organizational purposes.

15.Fraudulent or Abusive Accounts

You are not eligible to use The Tide for the purpose of:

• committing fraud
• operating scams
• exploiting another person
• soliciting money under false pretenses
• stealing identities
• phishing
• distributing malware
• harassing or stalking people
• facilitating illegal activity
• exploiting children
• manipulating the Tide community
• engaging in other serious violations of our policies

Accounts created or used primarily for these purposes may be immediately restricted or terminated.

16.Verification

The Tide may, but is not required to, request information reasonably necessary to determine whether an account satisfies our eligibility requirements.

Depending on the circumstances, we may request verification relating to:

• age
• control of an email address
• account ownership
• authorization to represent an organization
• suspected impersonation
• suspected fraud
• attempts to circumvent enforcement

A request for verification does not necessarily mean The Tide suspects wrongdoing.

Failure to provide reasonably requested information may result in certain features being restricted or an account being suspended when we cannot otherwise determine eligibility.

17.Changes in Eligibility

You must continue to satisfy applicable eligibility requirements while using The Tide.

If circumstances change so that you are no longer legally eligible to use the Service, you should stop using the Service.

We may also modify eligibility requirements as The Tide develops, particularly where necessary to address:

• changes in law
• new features
• safety considerations
• geographic expansion
• new types of accounts
• regulatory requirements

18.Enforcement

If we reasonably believe that you do not satisfy this Eligibility Policy, we may take actions including:

• requesting additional information
• restricting certain features
• temporarily suspending your account
• removing an account
• preventing creation of additional accounts
• taking other reasonable steps necessary to protect The Tide and its community

Where appropriate and legally required, we may provide notice or an opportunity to appeal an eligibility decision.

19.Reporting an Ineligible Account

If you believe an account:

• belongs to a child under 13
• impersonates another person
• falsely represents an organization
• was created to evade a previous termination
• is operated primarily by unauthorized automation
• is being used for fraud or exploitation
• otherwise does not meet these eligibility requirements

you may report the account using the reporting tools available through The Tide.

Reports should be made in good faith.

Knowingly submitting false reports to harass another person may itself violate our Community Guidelines.

20.Relationship to Other Tide Policies

Meeting the requirements of this Eligibility Policy gives you permission to create or maintain an account subject to our other policies.

It does not exempt you from complying with our:

• Terms of Service
• Privacy Policy
• Cookie Policy
• Community Guidelines
• Risk Disclosure
• other rules applicable to particular features

If your conduct violates those policies, The Tide may take enforcement action even if you otherwise satisfy this Eligibility Policy.

21.Changes to This Eligibility Policy

We may update this Eligibility Policy as The Tide evolves.

When we make changes, we will update the “Last Updated” date at the top of this page.

If we make a material change affecting existing members’ eligibility, we may provide additional notice through the Service, by email, or through another appropriate method where required.
